A.No.4566 of 2022 A.Nos.4566, 4567 & 4568 of 2022 in C.S.No.744 of 2009 G.CHANDRASEKHARAN.J., A.No.4566 of 2022 is filed to condone the delay of 140 days in filing the application to set aside the abatement caused due to the death of the deceased second plaintiff/C.P.David.

2.A.No.4567 of 2022 is filed to set aside the abatement and A.No.4568 of 2022 is filed to bring the applicants 4 and 5 as the legal representatives of the deceased second plaintiff. 3.The learned counsel for the defendants 1 and 2 have no objection for allowing this application.

4.Since, the delay is only 140 days and the legal representatives of the deceased second plaintiff has to be necessarily impleaded to further the case, these applications are allowed. Plaintiff is directed to take steps for amending the plaint.
