O R D E R
Writ of Mandamus filed to direct the respondent police to file final report in Crime No.1455 of 1999 pending on the file of the 2nd respondent police.

When the writ petition came up for admission, on the submission made by the Learned Government Advocate (Criminal Side), it was recorded that this is a case of house-breaking by an unknown person which occurred in the year 1999. The writ petitioner, who is the victim had sought completion of investigation through this writ petition.

This Court, on considering the facts of the case and the submissions made by the Learned Government Advocate(Crl.Side), directed the respondent police to complete the investigation in two months, if fails to trace the accused, necessary report to be filed. Alleging that the respondent police has not completed the investigation within the time prescribed, the present contempt petition is filed.
4. The Learned Government Advocate (Criminal Side) appearing for 2/5
the respondent has filed an affidavit stating that the case registered as Crime No. 1455 of 1999 under Sections 454 and 380 of the I.PC was closed on 30.10.2007 as "undetectable" and final report was filed before the XVIII Metropolitan Magistrate Court, Saidapet, Chennai.
5. The Learned Counsel appearing for the petitioner states that the complainant did not receive any closure report and that the alleged closure report now annexed with the affidavit needs to be verified whether it was really filed before the XVIII Metropolitan Magistrate Court, Saidapet, Chennai.
6. This Court holds that whether the closure report was served on the complainant or not cannot be verified at this point in time after a lapse of fourteen years. However, since the seal of the Metropolitan Magistrate, Saidapet is available on the closure report, this Court has no doubt about the filing of the closure report on 30.10.2007. Insofar as the Contempt Petition is concerned, had the respondent-police informed this Court that the complaint was already closed as not-traceable, the order directing the respondent-police to complete the investigation and file the final report within period of two months would not have been passed. Due to a communication gap, the above order was passed and now the record indicates that the accused is not-traceable and 3/5
complaint closed.
7. This Court is of the view that nothing survives in the order passed in the Writ Petition. Therefore, the Contempt Petition has to be closed.
8. Accordingly, this Contempt Petition is closed. 24.10.2025 Index :Yes/No.
