This Application has been filed to condone the delay of 81 days in filing the above captioned C.M.A against the decree and judgment passed in MACT.O.P.No.50 of 2020, dated 22.01.2022 on the file of the Motor Accident Claims TribunalNo.1, Thiruvallur. 2.Learned counsel for the appellant submitted that the 1st respondent remained ex-parte before the Tribunal and had also filed a petition to dispense with the notice of the 1st respondent. Though notice was served on the 2nd respondent, they had neither entered appearance in person nor through their counsel before this Court. 3.Heard the learned counsel for the petitioner. 4.Considering the averments made in the affidavit filed in support of this application and being satisfied with the same, the delay is condoned. Hence, this application is ordered as prayed for. 6.Registry is directed to number the C.M.A., if it is otherwise in order and the list the same in due course.
