The petitioner herein is an accused was arrested on 27.03.2025 in connection with the offence punishable under Sections 5(1), 6(1), 11(4), 12 of POCSO Act and 351(2) of BNS, in Crime No.09 of 2025, registered on the file of the respondent police, seeks bail.

2. The learned Government Advocate (Crl.Side) submits that the statement of the victim child clearly indicates that there was forceful sexual intercourse under the influence of drugs. Hence, on completion of th investigation final report was filed and taken on file by the Special Court for POCSO Offence at Dharmapuri in Spl.S.C.No.184 of 2025 and it has been posted for examination of witnesses on 09.09.2025.

3. Heard both sides and perused the materials available on record.

4. Considering the fact that the victim and the defacto complainant have not yet been examined and at this juncture, there is a possibility of tampering with the witness if the petitioner was released on bail. Hence, this Criminal Original Petition stands dismissed.
