Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the first respondent to dispose of the appeal of the petitioner petitioner dated 30.09.2019 insofar as to set aside the order passed by the second respondent in proceedings No.2400/M1/2017 dated 20.11.2018 and to refund the excess stamp duty paid amounting to a tune of Rs.3,05,850/- along with interest. ORDER

This writ petition is filed to issue a Writ of Mandamus, to direct the first respondent to dispose of the appeal filed by the petitioner petitioner dated 30.09.2019, insofar as to set aside the order passed by the second respondent in proceedings No.2400/M1/2017 dated 20.11.2018 and to refund the excess stamp duty paid amounting to a tune of Rs.3,05,850/- along with interest.

2. Considering the limited relief sought for in the petition, without expressing any opinion on merits of the writ petition, the first respondent is directed to dispose of the appeal filed by the petitioner dated 30.09.2019, after issuance of notice to the petitioner and counter parties, if any and after giving opportunity of hearing to them, pass orders on merits and in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order.

3. With the above direction, this writ petition is disposed of. No costs.
