The Official Liquidator, Madras As The Liquidator Of Namakkal Sree v. Nil

The application is filed by the Official Liquidator to call for claim from contributories of the company in liquidation and for orders incidental or ancillary thereto.

2. In support of the said application, a report dated 25.11.2021 is filed. In such report, it is stated that 8 claims were made by ordinary creditors. Out of the said 8 claims, 2 claims were admitted for a total sum of Rs.3,04,700/-. The other 6 claims were rejected on account of non-submission of original documents. Pursuant to the said adjudication, it is stated that divident was disbursed to creditors in respect of admitted claims at 100 paise to a rupee. In addition, interest at 4% p.a. was also disbursed. After said disbursement, it is stated that a sum of Rs.25,53,504.90 is available to the credit of the company in liquidation as on 17.11.2021.

3. In the above facts and circumstances, the present application is filed so as to call for claims from contributories. Upon examining the report of the Official Liquidator and on considering the submissions of the Deputy 1/3

Official Liquidator, I find that the present application is liable to be allowed as prayed for. Accordingly, the Official Liquidator is permitted to publish a notice in the prescribed form in one issue of the English daily, New Indian Express, and one issue of the Tamil daily, Dinamani, calling for claims from contributories of the company in liquidation. The Official liquidator is also permitted to incur expenses in relation thereto from and out of the funds of the company in liquidation.
