O R D E R
This Criminal Revision Case has been filed challenging the order dated 04.04.2025 passed in Crl.M.P.No.530 of 2025 in CSR No.174 of 2024 by the learned Judicial Magistrate No.II, Chengalpet, thereby imposed the condition that the petitioner shall execute a bond for
Rs.5,00,000/- along with two sureties each for a like sum to the satisfaction of the Court while allowing the petition.
2. Heard the learned counsel appearing on either side and perused the materials available on record.
3. The case of the petitioner is that he was defrauded by unknown persons through online to the tune of Rs.20,89,000/- in the year 2024. Therefore, the petitioner lodged a complaint before the respondent. During the course of investigation, the respondent froze the accounts of the fraudsters accounts to which the funds had been transferred. Thereafter, the petitioner filed a petition seeking the return of Rs.4,70,000/-, which is now frozen. While allowing the petition, the Trial Court imposed certain conditions on the petitioner. Aggrieved by the said conditions, the present criminal revision case has been filed.
4. Considering the facts and circumstances of the case, this Court is inclined to modify the conditions imposed by the Trial Court. Accordingly, the condition No.(i) imposed on the petitioner in Crl.M.P.No.530 of 2025 in CSR No.174 of 2024 on the file of the
Judicial Magistrate No.II, Chengalpet, is hereby deleted. All other conditions shall remain unaltered.
5. In the result, this Criminal Revision Case stands partly allowed.
