Petition praying that in the circumstances stated therein the High Court will be pleased to relax the condition that petitioner shall appear before the Special Judge (Special for trial of cases under Prevention of Corruption Act) first Monday of every English calendar month at 10.30a.m. until further orders by this Court by its order dated 11.04.2018 in Crl.MP.No.5778 of 2018 in Crl.A.No.241 of 2018.
Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of M/S.P.PALANIANATHAN, Advocate for the petitioner and of MR. K.PRABAKAR, ADDITIONAL PUBLIC PROSECUTOR on behalf of the Respondent the court made the following order:- The above petition is filed seeking to relax the condition imposed by this Court on the petitioner/Appellant/accused vide order dated 11.04.2018 made in Crl.MP.No.5778/2018 in Crl.A.No.241/2018. This Court, by its order dated 11.04.2018, had suspended the sentence imposed on the petitioner with a direction to report before the Special Judge (Special for trial of cases under PC Act) at 10.30 a.m., on the first Monday of every English Calendar Month pending appeal.
The learned counsel for the petitioner would submit that the petitioner is a senior citizen and is suffering from age related aliments and would seek relaxation of the condition of appearing before the Trial Court on the first Monday of every month. Heard the learned Additional Public Prosecutor on the submissions made by the learned counsel for the petitioner. https://hcservices.ecourts.gov.in/hcservices/
Taking into consideration the submissions made by the learned counsel, the condition imposed by order dated 11.04.2018 is hereby modified. The petitioner shall appear before the trial Court on the first working day of September-2019 and thereafter once in three months on the first working day of the concerned month, pending disposal.
The petition is ordered accordingly.
