Prayer:- Writ petition filed under Article 226 of the Constitution of India praying for issuance of a writ of Mandamus, Forbearing the respondents 1 to 6 from interfering with the petitioners peaceful possession and enjoyment of all the lands comprised in S.No.115/2A1 in all measuring 1.62 Hectares namely 4 acres situated at Village No.54, Surapattu Maduramedu Village, Madhavaram Taluk, Tiruvallur District within the Sub-registration district of Ambattur and within the registration district of South Chennai in any manner inclusive of dispossession either by themselves, their workmen, executors, administrators, agents and assigns etc.

O R D E R

This Writ Petition has been filed for a direction forbearing the respondents from interfering with the petitioners' peaceful possession and enjoyment of the land comprised in S.No.115/2A1, measuring an extent of 1.62 Hectares, namely, 4 acres situated at Village No.54, Surapattu Maduramedu Village, Madhavaram Taluk, Tiruvallur District. 2/6

2. Heard the learned counsel appearing on either side and perused the materials available on record.

3. According to the petitioners, they are in possession and enjoyment of the subject land, which is classified as Gramanatham. Further, some persons occupying similar lands have been issued patta. In so far as the subject land is concerned, it was originally classified as Meikkal Poramboke and was subsequently re-classified as Gramanatham. Therefore, the petitioners' possession cannot be disturbed by any means.

4. On perusal of the counter filed by the 6th respondent it is revealed that the original extent of the property comprised in S.No.115/2A1 is 10.25 Hectares. Out of the said property, an extent of 1.62 hectares was in possession and enjoyment of one Krishna Pillai. Thereafter, the said Krishna Pillai executed an unregistered Will in favour of the petitioners. However, they were not issued patta as it is classified as Meikkal Government Poramboke land.

5. Further, a proposal for allotment of the subject land in favour of the Animal Husbandry, Dairying, Fisheries, and Fishermen Welfare Department has already been submitted. Though the petitioners contended 3/6

that the classification of the subject land changed from Meikkal Poramboke to Gramnatham, no such entry is available in the land records.

6. Therefore, the petitioners cannot claim any right over the subject property. However, in the event that the respondents intend to take possession of the subject property, they shall first initiate appropriate proceedings against the petitioners in accordance with law to obtain possession of the subject land.

7. Accordingly, this Writ Petition stands dismissed. No costs. Consequently, the connected Miscellaneous Petition is closed. 09.10.2025 Index : Yes/No Speaking Order: Yes/No (shr) 4/6
