Heard the learned counsel for the petitioner. Mr.P.G.Thyagu, learned counsel for the respondent strongly opposed the application.

2. I have considered the reasons stated in the affidavit filed in support of the petition and am satisfied that sufficient cause is made out, especially the suit is for partition. Hence, the delay is condoned and the petition is ordered.

3. Registry is directed to place the CMP for restoration of the appeal and the second appeal on 30.03.2023 on the top of the list.
