This writ petition has been filed for issue of writ of mandamus directing the respondent to consider the representations made by the petitioner wherein, the petitioner is seeking for revising the order dated 01.08.2019 which dealt with the promotion to the post of Assistant Accounts Officer w.e.f., 20.10.2016 and to amend the promotion order dated 23.02.2021,which dealt with the promotion from the post of Administrative Officer to Accounts Officer and to regularize the leave period from 29.08.2016 to 21.02.2017 and consequently to rectify the retirement benefits of the petitioner and also the pension granted to the petitioner. 2.Heard Mr.D.Prabhu Mukunth Arunkumar, learned counsel appearing on behalf of the petitioner and Mr.S.Manikandan, learned Standing Counsel appearing on behalf of the respondent.
3.The case of the petitioner is that he was promoted as Assistant Accounts Officer on 01.08.2019 and thereafter, he was promoted as an Administrative Officer w.e.f., 23.02.2021. According to the petitioner, he should have been 2/4
promoted as an Assistant Accounts Officer w.e.f., 20.10.2016 by properly following the reservation for differently abled person. Once this is done, the subsequent promotion to the post of Accounts Officer will also have a bearing. That apart, the petitioner also wanted the period from 29.06.2016 to 21.02.2017 to be regularized. Consequently, the petitioner is also seeking for other attendant benefits. The representation made by the petitioner in this regard was not considered and therefore, the present writ petition has been filed before this Court seeking for appropriate directions.
4.Taking into consideration the facts and circumstances of the case and without going into the merits of the case, there shall be a direction to the petitioner to submit a fresh representation to the respondent, within a period of two weeks from the date of receipt of copy of this order. The representation shall be annexed with all the relevant documents and also a copy of this order. The respondent shall deal with the same on its own merits and in accordance with law and take a decision within a period of eight weeks from the date of receipt of the fresh representation from the petitioner and convey the same to the petitioner. 3/4
