Petitioner has come up with the present writ petition seeking a writ of mandamus directing the respondents herein to issue the petitioner MBBS Degree Certificate and +2 Mark Certificate.

2. After some elaborate arguments both the learned counsel agree that the issue involved in this writ petition had already been decided by the Division Bench of this Court in W.P.No.1884 of 2008 and the writ petitioner had also made the second application for issuance of community certificate and the same is now pending before the Revenue Divisional Officer. Learned counsel for the petitioner would state that it would suffice that if a direction is issued to the Revenue Divisional Officer concerned for early disposal of the application as the petitioner had already completed the Degree course.

3. Learned Special Government Pleader would also submit that the Original Community Certificate produced by the petitioner at the time of admission itself is a forged one.

4. In such view of the matter, this court is not expressing any view about issuance of community certificate and would direct the third respondent/Revenue Divisional Officer to conduct enquiry after providing opportunity to the petitioner as well as to the respondents and complete the enquiry in respect of the community status of the petitioner and dispose of the application of the petitioner, within a period of three months, from the date of receipt of the copy of this order. This writ petition is disposed of.
