ORDER
This Civil Revision Petition is filed seeking a direction to the learned Principal District Munsif Court, Alandur, to dispose of petition filed by the revision petitioners under Section 11(4) of the Tamil Nadu Buildings (Lease and Rent Control Act), in M.P.No.1 of 2022 in RCOP.No.45 of 2018.
2. Having regard to the limited prayer made in this revision, this Court is inclined to dispose of this revision, even without notice to the respondents.
3. The revision petitioners/landlords are seeking eviction of the second respondent in RCOP.No.45 of 2018. Pending eviction proceedings, the 2/4
petitioner filed a petition under Section 11(4) of the Tamil Nadu Buildings (Lease and Rent Control Act), in M.P.No.1 of 2022 and the same is pending.
4. The perusal of the E-Court entry filed in the typed set of papers would suggest that the respondents failed to file any counter to the petition filed by the revision petitioners and they were set exparte as early as 05.02.2019 itself.
5. The learned counsel for the petitioners submitted that the respondents have not filed a petition to set aside the exparte order and the same is recorded.
6. In view of the fact that the respondents were already exparte as early as February 2019, this Court is inclined to issue a direction to the Court below to dispose of RCOP.No.45 of 2018 within a period of four months from the date of receipt of a copy of this order. 3/4
