O R D E R
This Criminal Revision Case has been filed challenging the order dated 09.06.2025 passed in Crl.M.P.No.75 of 2025 by the Judicial Magistrate, Thiruthuraipoondi, thereby dismissing the petition seeking a direction under Section 175(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023 to register an FIR.
2. Heard the learned counsel appearing for the petitioner and the learned Government Advocate appearing for the first respondent. Perused the materials available on record.
3. A perusal of the complaint lodged by the petitioner reveals that the petitioner lodged a complaint before the first respondent and he was issued CSR No.1161 of 2024 on 16.06.2024. After
conducting an enquiry, the said complaint was closed. Aggrieved by the same, the petitioner filed a petition under Section 175(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeking a direction to register an FIR. Further, it is stated that on 15.06.2024, certain known persons along with three unknown persons locked the petitioner's door and threatened him with dire consequences.
4. It is seen from the records that there is a civil dispute between the petitioner and the counter parties. According to the petitioner, when he intended to survey his land, the first respondent and his men obstructed the revenue authorities from surveying the property. In this regard, it is pertinent to observe that if at all the surveyor finds any obstructions from third parties, the concerned surveyor can very well approach the concerned jurisdictional police seeking police aid to survey the land.
5. Insofar as the other allegations are concerned, there is absolutely no specific averments against the accused so as to constitute any offence. Therefore, the Trial Court rightly dismissed the petition and this Court finds no infirmity or illegality in the order dated 09.06.2025
passed in Crl.M.P.No.75 of 2025 by the Judicial Magistrate, Thiruthuraipoondi.
6. In the result, this Criminal Revision Case stands dismissed.
