Heard the submissions of the learned counsel for the petitioner and Mr.M.Mohamed Riyaz, learned Additional Public Prosecution appearing on behalf of the respondent.

The petition is ordered and the delay of 170 days in filing the Criminal Appeal filed against the judgment of conviction and sentence passed in S.C.No.122 of 2012, dated 07.01.2019, on the file of the learned XVII Additional Sessions Judge, Chennai is hereby condoned.

The Registry is directed to number the Criminal Appeal if it is otherwise in order and list the same for hearing.
