ORDER

This petition has been filed seeking for modification of the condition imposed by the Court below while granting anticipatory bail to the petitioner.

2.The petitioner apprehended arrest by the respondent police in Crime No.183 of 2019. He filed anticipatory bail petition before the Court below and the Court below after taking into consideration the facts and circumstances of the case, granted anticipatory bail by imposing certain conditions. One of the condition imposed by the Court below is that the petitioner should appear before the respondent police daily and sign twice at 10 a.m. and 5 p.m., until further orders.

3.The learned counsel for the petitioner submitted that the petitioner is aged about 75 years and there was no requirement for the Court below to impose such a stringent condition. The learned counsel further submitted that the petitioner is not in a position to comply with the said condition. https://hcservices.ecourts.gov.in/hcservices/

4.Heard, the learned Additional Public Prosecutor appearing on behalf of the respondent police.

5.Taking into consideration the facts and circumstances of the case, the condition imposed by the Court below is modified and the petitioner shall appear before the respondent police as and when required during the course of investigation. Other conditions imposed by the Court below shall stand as it is and the petitioner is directed to surrender before the concerned Court within a period of two weeks from the date of receipt of a copy of this order and execute the bond.

6.This Criminal original petition is disposed of accordingly.
