When the matter came up for hearing on 19.06.2024, there was no representation for the appellant. Hence, the Registry was directed to list the matter under the caption 'for dismissal' on 20.06.2024. Today, when the matter is called, the learned counsel for the appellant would state that she is not able to contact the appellant and reported no instructions. There is no appearance for the respondent. It appears that the parties are not interested in prosecuting the case. Therefore, this Court has no other option except to dismiss the civil miscellaneous appeal for nonprosecution. Accordingly, the Civil Miscellaneous Appeal is dismissed for non-prosecution. No costs.
