The learned counsel appearing on behalf of the appellant made a submission that the issues between the parties are settled out of the Court. Thus, the appellant has chosen to withdraw the appeal suit. Accordingly, the appellant is permitted to withdraw the first appeal and the Registry is directed to repay the Court fee as applicable and by following the procedures contemplated. Consequently, the first appeal stands dismissed as withdrawn. No costs.
