Respondent PRAYER : Criminal Appeal filed under Section 378(1)(b) of Criminal Procedure Code, pleased to set aside the Judgment of acquittal of the respondent/accused passed by the learned Special Judge cum Chief Judicial Magistrate, Cuddalore District, Cuddalore in Special Case No.02 of 2009 dated 28.12.2015, convict and sentence the respondent/accused of the charges framed against him.

O R D E R

This Criminal Appeal has been filed seeking to set aside the judgment passed by the learned Special Judge cum Chief Judicial Magistrate, Cuddalore District, in Special Case No.02 of 2009 dated 28.12.2015.

2. It is submitted by the learned Government Advocate (Crl.Side) that the State has preferred this Appeal against the acquittal of the respondent/accused for the offence under Sections 7, 13(2) r/w 13(1)(d) of the Prevention of Corruption Act. Further, during the pendency of the appeal, the appellant came to know that the respondent passed away on 12.06.2021 and he has also produced the death certificate of the respondent/accused. He further submitted that on account of death of the respondent, the State is also not interested to proceed further and thereby, he prayed that the appeal may be closed.

3. Recording the submissions made by the learned Government Advocate (Crl.Side) that the respondent has passed away and after perusing the death certificate of the respondent, this Court finds that nothing survives for further adjudication in this Criminal Appeal.
