ORDER : The Court Made the following order :- (The case has been heard through video conference) The petitioners who were arrested and remanded to judicial custody on 22.10.2021 for the offences under Sections 294(b), 324, 353, 506(2) r/w 307 of IPC, in Crime No.571 of 2021, on the file of the respondent police, seek bail.

2. The case of the prosecution is that when the de facto complainant returning from his duty the petitioners waylaid and attempted robbery with decoity and threatened the de facto complainant. Hence, the complaint.

3.The learned counsel for the petitioners would submit that the petitioners are no way connected with the alleged offence and they have been falsely implicated in this case. He would further submit that the petitioners have been suffering incarceration for more than 35 days from 22.10.2021 and hence, he would pray for grant of bail to the petitioners.

4.The learned Government Advocate (Crl. Side) would raise strong objection stating that the 1st petitioner is detained under Goondas and the 2nd petitioner has got 13 previous cases and he is a habitual offender and further states that for 2nd petitioner there is proposal for Goondas.

5.Considering the fact that A1 is detained under Goondas and A2 has got several previous cases, this court is not inclined to grant bail to the petitioners. Accordingly, this Criminal Original Petition is dismissed.
