O R D E R

The petitioner has come forward with this petition seeking for a direction, to withdraw the proceedings in S.C.No.39/2015 pending on the file of the Mahila Court, Erode and transfer the same to the file of the Mahila Court, Coimbatore making allegation against the Presiding Officer, Mahila Court, Erode. 2.Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondent.

3.A perusal of the remarks submitted by the Presiding Officer, Mahila Court, Erode, it is seen that Section 317 Cr.P.C. petition has been filed by the Accused No.2 since her son was not well but whereas in the petition, it has been stated that she was not well. Counter has been filed on 04.01.2016 and the Section 317 Cr.P.C. petition has been dismissed on 11.01.2016. After hearing both sides, charges were framed on 02.03.2016 and for examination of other witness, the case has been posted.

4.Considering the report received from the Presiding Officer, Mahila Court, Erode, I do not find any reason to transfer the case in S.C.No.39 of 2015 from the file of the Mahila Court, Erode. Hence, the Criminal Original Petition is dismissed. However, the Presiding Officer, Mahila Court, Erode is directed to dispose of the case in S.C.No.39 of 2015 within a period of one month from the date of receipt of a copy of this order.
