Criminal Original Petition is filed under Section 482 of the Code of Criminal Procedure to direct the earlier disposal of C.C.No.4016 of 2010 on the file of the XVII Metropolitan Magistrate, Saidapet, Chennai - 15.

O R D E R

Even though this Court by an order dated 16.02.2016 had called for the status report from the learned XVII Metropolitan Magistrate, Saidapet, Chennai in respect of C.C.No.4016 of 2010, the same was not received till date. However, both the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the first respondent would submit that all the accused persons had appeared before the Trial Court, except A6, who had died.

2. In view of the said submission, I am of the considered view that it is a fit case to direct the Trial Court to dispose of the case at the earliest. Accordingly, the learned XVII Metropolitan Magistrate, Saidapet, Chennai is directed to dispose of the case in C.C.No.4016 of 2010, within a period of two months from the date of receipt of a copy of this order.

3. At this juncture, the learned Additional Public Prosecutor would submit that the accused had cross-examined only one witness and the other witnesses had to be cross-examined and hence, they may be directed to co-operate for the earlier disposal of the matter.

4. Considering the submission made by the learned Additional Public Prosecutor, the petitioner is directed to co-operate for the earlier disposal of the matter.

5. The Criminal Original Petition is disposed of with the above direction.
