PRAYER: This Criminal Original Petition is filed under Section 482 of Cr.P.C, praying to direct the 2nd respondent to execute the warrant issued on 17.04.2017 in connection with S.C. O R D E R

The prayer in the present petition is to direct the 2nd respondent to execute the warrant issued on 17.04.2017 in connection with S.C. NO. 54 of 2015 on the file of the learned II Additional District and Sessions Court, Erode.

2. Heard both sides and perused the documents available on record.

3. On a perusal of records, it is seen that this Court while allowing the Crl.A. No. 462 of 2016 by an order dated 16.07.2017 filed by the petitioner herein, has directed the accused to surrender before the trial Court within a period of four weeks. Since the accused did not comply the orders of this Court, the trial Court has issued Non Bailable Warrant as against this accused on 17.04.2017, directing https://hcservices.ecourts.gov.in/hcservices/

the 2nd respondent to secure the accused in connection with SC. No. 54 of 2015 on the file of the II Additional District Judge, Erode. It is also seen that the NBW issued by the trial Court on 17.04.2017 is still pending with the 2nd respondent.

4. In such circumstances, it would be appropriate to direct the 2nd respondent to execute the Non Bailable Warrant issued as against the accused in S.C. No. 54/2015 dated 17.04.2017 on the file of the II Additional District Judge, Erode, within a period of four weeks from the date of receipt of a copy of this order.

With the above directions, the present Criminal Original Petition is disposed of.
