Respondent Criminal Appeal has been filed under Section 374(2) of Cr.P.C., to set aside the judgment and sentence passed by the Hon'ble Principal Special Judge, Princpal Special Court under NDPS Act, Chennai in C.C.No.8 of 2005, dated 30.06.2017 convicting and sentencing the appellant to undergo 10 years RI and imposed a fine of Rs.100000/- for alleged offences under Section 8(c) r/w 21(b) of NDPS Act and another10 years RI and imposed a fine of Rs.1,00,000/- for alleged offences under Section 8(c) r/w 25 of NDPS Act and both the sentence to run concurrently. JUDGMENT

The Criminal Appeal is filed by the accused against the judgment of conviction passed by the trial Court for the offence under Sections 8(c) r/w 21(b) and 8(c) r/w 25 of NDPS Act. 2.

The trial Court, after examining the witnesses had found the accused guilty and sentenced him to undergo 10 years RI and imposed a fine of Rs.1,00,000/- for the offence under Section 8(c) r/w 21(b) of NDPS Act and to undergo 10 years RI and imposed a fine of Rs.1,00,000/- for the offence under Section 8(c) r/w 25 of NDPS Act.(Total fine of Rs.2,00,000/-). Both the sentence was ordered to run concurrently. The period of sentence already undergone by the appellant shall be set off. The judgment of conviction is the subject matter of this appeal.

The learned counsel appearing for the appellant, after making some efforts to convince this Court that the trial Court judgment is perverse, sought leave of this Court to withdraw the 2/4

Appeal.

4. On his request, the appellant is permitted to be withdrawn the appeal and necessary endorsement is made by the learned counsel appearing for the appellant to that effect.

5. In view of the above, this Criminal Appeal is dismissed as withdrawn. No costs.
