PRAYER: Writ Petition filed under Article 226 of the Constitution of India, pleased to issue a Writ of Certiorarified Mandamus, call for the records relating to the impugned order of the 4th respondent in Ma.A.9.Na.Ka.No. H2 / 1377 / 2020 dated 20.07.2022 and quash the same as the same is arbitrary, illegal and non-est in the eyes of law and consequently direct the respondents 1 to 4 to grant appointment for the petitioner's daughter namely M. ORDER

The present Writ Petition is filed challenging the impugned order dated 20.07.2022, whereby the petitioner's request for appointment on compassionate ground was rejected on the premise that the scheme does not provide for appointment to more than one dependant of the deceased Government servant.

It is pointed out by the learned counsel for the petitioner that no one of the family of the deceased employee, Mr.K.P.Mani, who was working as a Mazdoor in old Zone-6 of Chennai Corporation, has been granted appointment on compassionate grounds. The said K.P.Mani passed away on 26.05.2008 while in service. Initially an application was filed by the deceased K.P.Mani's

first wife on 01.06.2009. Petitioner, who is admittedly the second wife of the said deceased K.P.Mani, filed an application on 27.11.2019, followed by an application by petitioner's daughter on 10.09.2020.

3. The application filed by the petitioner was rejected on the premise that more than one dependant of deceased employee cannot be granted an appointment as compassionate basis, according to the petitioner, is contrary to facts, inasmuch as no one in the family of the said deceased K.P.Mani has been provided with any employment on a compassionate basis. Since this ground which is really non-existent and factually incorrect, this Court is inclined to direct the respondent to reconsider the petitioner's application in accordance with law. It is made clear that this Court has not expressed any opinion on the merits of the case. The request shall be examined strictly in accordance with laws, relevant Rules, and Government Orders governing compassionate appointment during the relevant period.

4. The Writ Petition stands disposed of with the above observation. There shall be no order as to costs.
