The petitioner who is husband of A.1, apprehends arrest at the hands of the respondent police for the alleged offence under Section 420, 294(b), 506(2) of IPC registered in Cr.No.80 of 2023, seeks anticipatory bail.

2. The case of prosecution is that the defacto complainant has given a false complaint before the respondent police alleging that the petitioner has cheated him and threatened him with dire consequences.

3. The learned counsel for the petitioner submitted that due to financial transaction, has projected as a case of job racketing. He further submitted that A.1 to A.3 were arrested and released on bail by this Court on 28.03.2023 in Crl.OP No.6941 of 2023.

4. The learned Government Advocate (crl.side) would contend that on an earlier occasion, Crl.OP No.4222 of 2023 was allowed with condition 1/4

to deposit a sum of Rs.3,00,000/- to the credit of Crime Number and to appear before the respondent police on alternative days for a period of three months. However, the petitioner has not complied with the said order and suppressed the earlier order of this Court in Crl.OP No.16821 of 2023 which was dismissed by this Court on 08.08.2023. He further submitted that investigation has now been transferred to District Crime Branch, Kallakurichi District; that A.1 to A.3 were arrested and remanded to judicial custody and later released on bail.

5. Heard the learned counsel for the petitioner as well as Government Advocate (Crl.side) and perused the records.

6. In the present application, I find that it is averred that earlier application in Crl.OP No.4222 of 2023 was filed by the petitioner's wife, without the knowledge of the petitioner. From the counter, I find that after the investigation by the District Crime Branch, Kallakurichi, so far 54 complaints have been received that on the assurance of providing jobs of Supervisor, Salesmen, Office Assistants, Drivers, Pharmacists and Junior Assistant posts in the Prohibition & Excise Department and Revenue 2/4

Departments and that Rs.1,14,50,000/- was alleged to have been credited to the account of the petitioners.

Considering the gravity of the offence and also the fact that now after the investigation has been taken over by the District Crime Branch, Kallakurichi, number of victims have been increased to 54 and more than One Crore is alleged to have been cheated by the petitioner alongwith other co-accused, I am not inclined to grant anticipatory bail to the petitioner for the present.

8. Accordingly, this Criminal Original Petition is dismissed. rgr 3/4
