The petitioner herein sought for drinking water supply from Panchayat has paid Rs.40,000/- as a laying charge. However, the neighbour alleged to have made an objection to lay the pipeline in front of his house.

2. The learned Government Advocate (Crl.Side) appearing for the respondent police submits that on complaint given by the petitioner, CSR been registered and both the parties were called for enquiry, matter is pending.

3. This Court considering the representation made by the petitioner and counter filed on behalf of the Inspector of Officer. The pipeline supposed to be laid by the Panchayat for the purpose of supplying drinking water, the pipe line has to be laid by digging the government road. Therefore, the charge of Rs.40,000/- already been collected by the Panchayat.

4. While so, there cannot be any impediment for the authority to 2/4

lay pipeline. No person can object Panchayat for laying pipeline in the public road and temporary digging of the road for the said purpose. Therefore, if the Panchayat seeks police protection to lay the pipe line, the respondent police is directed to give adequate protection.

5. With this direction, Writ Petition is disposed of. No order as to costs.
