These applications have been filed to condone the delay of 743 days in filing a petition to set aside the order of abatement as against the first respondent Mr.Mohammed Saud Ali, to set aside the abatement and to bring on record the legal representatives of the deceased first respondent.

2. Considering the nature of dispute between the parties, the delay has to be condoned, and the abatement is liable to be set aside and the legal representatives of the deceased Jayavelu has to be brought on record, to advance substantive justice.

Accordingly, these applications are allowed. The applicant is directed to carryout amendment and file amended plaint copy.
