Notice was issued by this Court on 16.12.2021. The other side is served, no one has appeared.

Learned advocate for the appellant has submitted that, even otherwise the limitation got expired during the period which is treated to have been condoned by the Supreme Court by a separate order considering the pandemic situation in the country.

Considering the totality, delay is condoned and civil miscellaneous petition is allowed.
