and consequently to direct the respondent to pay the monthly maintenance to increase the amount from Rs.10,000 to Rs.20,000 for the 1st petitioner and maintenance to increase the amount from Rs.10,000 to 20,000 for the 2nd petitioner including Medicine, food, Education and Clothing total maintenance Rs.40,000.

ORDER

Challenging the impugned order dated 04.03.2025 passed in M.C.No. 266 of 2023 by the Principal Family Court, Chennai, the petitioners have preferred this Criminal Revision Case.

2. Before the Family Court, Chennai, the petitioners have claimed maintenance of Rs.20,000/- per month for herself and a sum of Rs.30,000/- per month for her minor son. On contest, the Family Court had partly allowed the petition and directed the respondent to pay a sum of Rs.10,000/- per month to the 1 st petitioner and a sum of Rs.10,000/- per month to the 2 nd petitioner towards maintenance. Now, this Criminal Revision Case has been preferred for enhancement of compensation.

The learned counsel for petitioners would submit that the respondent husband is earning a sum of Rs.74,000/- as his gross salary, but the Family Court failed to take note of the same and erroneously fixed only a sum of Rs.20,000/- without considering educational expenses of minor son. Hence, they prayed for enhancement of maintenance.

4. As per the salary certificate enclosed in the typed set of papers, it shows that the respondent is earning a sum of Rs.74,408/- as his gross salary and his net salary is Rs.56,491/- per month. However, minor son is under the care of 1 st petitioner and as on date, she is not having any other source of income and she is under the care of her mother. Therefore, this Court is inclined to enhance the maintenance from Rs.10,000/- to Rs.12,000/- per month to the 1 st petitioner and from Rs.10,000/- to Rs.15,000/- to the minor son, totally a sum of Rs.27,000/- per month. The respondent is directed to pay the said maintenance from September 2025 onwards without fail. If any deviation, the amount will be attached as per the manner known to law including arrears. Accordingly, this Criminal Revision Case is disposed of.
