... Respondents This case came up for settlement before the National Lok Adalat. Both the parties are present. Mr.S.Udhayakumar, learned nd counsel for the appellants and M.K.Vinod, learned counsel for 2 respondent/Insurance Company are present. After mutual discussion, negotiation, mediation and conciliation between both parties, they arrived at a compromise to settle the matter as follows:

TERMS OF SETTLEMENT The appellants have preferred this Civil Miscellaneous Appeal seeking to enhance the Award dated 12.12.2024 in M.C.O.P.No.1238 of 2020 passed by the learned Principal Subordinate Judge, Motor Accidents Claims Tribunal, Krishnagiri.

2. The Tribunal has passed an award of Rs.2,64,803/- with interest at the rate of 7.5% per annum from the date of petition till the date of deposit along with cost.

3. The parties are present along with their respective

counsels. The appellants have preferred the present Civil Miscellaneous Appeal for enhancement of award amount of Rs.2,64,803/-.

4. The original award amount was already deposited by the nd respondent and the same has been withdrawn by the appellants/claimants.

5. After great deliberation and discussion, both the parties have agreed for enhancement of award amount with further additional sum of Rs.1,25,000/- in full quit (inclusive of interest).

6. In view of the compromise arrived at between the parties, the National Lok Adalat hereby declare and decree that nd respondent/Insurance Company shall deposit the enhanced award amount of Rs.1,25,000/- (Rupees One Lakh and Twenty Five Thousand only) in full quit (inclusive of interest), within a period of six weeks from the date of receipt of a copy of this award. On such deposit, appellants are permitted to withdraw the enhanced award amount immediately, without filing any formal petition, before the competent Court.

7. It is made clear that out of the enhance award amount st Appellant is entitled to Rs.50,000/- and of Rs.1,25,000/-, 1 Appellant Nos.2 to 4 are entitled to Rs.25,000/- each.

8. The Tribunal is directed to issue the cheques to the parties concerned on proper identification in accordance with the terms of the award, without insisting on any formal permission petition. The Civil Miscellaneous Appeal is disposed of accordingly.
