Respondents PRAYER: Criminal Original Petition has been filed under Section 482 of the Code of Criminal Procedure to direct the respondents to register an FIR against the accused person, based on the complaint dated 13.11.2021 for offences committed by accused person.

ORDER

This criminal original petition has been filed to direct the respondents to register an FIR against the accused person, based on the complaint dated 13.11.2021.

2.The grievance of the petitioner is that the petitioner sent a complaint by post on 13.11.2021, no action has been taken.

3.The learned counsel for the petitioner submits that the petitioner is a Branch Head of Manapuram Finance Limited, T.Nagar Branch. During the course of business, she received jewels and processed certain loans, which now have been termed to be not proper following the guidelines and thereafter, the petitioner's customers have not repaid the loan amount. Hence, she had lodged a complaint of misappropriation to the tune of Rs.13,44,000/-.

4.The learned Additional Public Prosecutor submits that the petitioner had sent a complaint through post. She needed to appear before the respondents police along with the copy of the complaint and to give her explanation. Further, he submits that the Manapuram Finance limited had lodged a complaint under Section 156(3) Cr.P.C, which is pending. The petitioner, on coming to know about the steps being taken by the Manapuram Finance Limited, as a counter blast and defence, had sent this complaint. In any event, the petitioner to appear before the respondent police and give her explanation along with the documents. Thereafter, appropriate steps to be taken. 5.The counsel for the petitioner, on instructions, submits that the petitioner is ready and willing to appear before the respondent police on any given date.

6.In view of the same, the petitioner is directed to appear before the respondent police on 22.12.2021 along with the copy of the complaint and documents available with her and give explanation. Thereafter, the respondent police is directed to enquire and proceed in accordance with law.

7.With the abovesaid direction, the criminal original petition is disposed of.
