Respondent PRAYER: Criminal Original Petition has been filed under Section 482 of the Code of Criminal Procedure, to direct the respondent to take his complaint dated 15/11/2021 to file, investigate into the matter register a case and proceed against Parvathinathan as per law.

ORDER

The petitioner lodged a complaint on 15.11.2021. In the complaint itself, he stated that he has been cheated by one Parvathinathan claiming to be having good contacts in high places. He promised to get job in Aavin, for which, he collected around Rs.3,00,000/- from the petitioner and thereafter, cheated the petitioner. Hence, the petitioner lodged a complaint and CSR No.819 of 2021 assigned, thereafter, no action has been taken.

2.The learned Additional Public Prosecutor submits that on the complaint of the petitioner, CSR No.819 of 2021 assigned on 21.11.2021. Both the petitioner and the counter petitioner Parvathinathan were called for enquiry. At that time, the said Parvathinathan returned Rs.50,000/- and promised that balance Rs.2,50,000/- will be paid on 25.11.2021. He further submits that there are similar complaints against the said Parvathinathan and the complaint of the petitioner has been sent for Legal opinion, thereafter, the case would be dealt in accordance with law.

3.The learned counsel for the petitioner denied about any compromise arrived between the petitioner and Parvathinathan. Further submits that he has not received any amount from the said Parvathinathan.

4.Recording the same, this Criminal Original Petition is disposed of.
