O R D E R

This petition has been filed to quash the proceedings in C.C.No.41 of 2009 pending before the learned I Additional Special Judge for NDPS Act Cases at Chennai for the offences under Section 8(c) r/w 21 and 29 of the NDPS Act, 1985.

2. Mr.R.C.Paul Kanagaraj, learned counsel for the petitioner submits that the petitioner implicated based on the confession, under Section 29 of the NDPS Act and statement under Section 67 of NDPS Act and there was no possession recovered from the petitioner.

3. Mr.N.P.Kumar, learned Special Public Prosecutor for DRI Cases submits that totally there are three accused involved in this case. A1 had been convicted and completed his sentence in this case and the petitioner is A2. He further submits that A3 is absconding accused and the case as against A3 had been transferred to Long Pending Case in C.C.No.38 of 2013. After full-fledged trial, the trial Court by judgment dated 03.04.2017 acquitted the petitioner/A2 from all the charges in C.C.No.41 of 2009.

4. Recording the above submissions, nothing survives for adjudication in this petition. Accordingly, this Criminal Original Petition is disposed of. Consequently, connected miscellaneous petitions are closed.
