This Writ petition has been filed to issue a Writ of Mandamus, directing the respondent not to harass the petitioner in Crime No.Not Known of 2021 on the file of the third respondent police.
2. The petitioner's averment is that on the complaint given by one Muthuramalingam, he was asked to appear for enquiry and he appeared on 16.11.2021. Thereafter, under the guise of enquiry, he was again asked to appear on 17.11.2021, 18.11.2021 and 29.11.2021 and thus, facing harassment at the hands of the respondent Police. Since the complainant Muthuramalingam is very close to a leader of the ruling political party, who is holding https://hcservices.ecourts.gov.in/hcservices/
a Constitution Position in Delhi, a false case has been filed against him.
3.The learned Additional Public Prosecutor submits that on the complaint of the said Muthuramalingam, CSR.No.1028 of 2021 was assigned on 20.10.2021. After investigation, First Information Report came to be registered in Crime No.610 of 2021 for the offence under Sections 406, 420 and 34 of IPC and the petitioner was arrested.
4.Since the petitioner/accused was arrested in Crime No.610 of 2021, this petition has become infrucutuous.
