This Civil Miscellaneous Petition has been filed to condone the delay of 389 days in filing the above appeal.

2. Heard the learned counsel for the petitioners.

3. Despite the receipt of notice, none represents the 2nd respondent.

4. The 1st petitioner would aver that on account of the accident that took place on 01.07.2016, she lost her son. She would further aver that her does not have a regular job and due to financial constrains, delay of 389 days occurred in preferred the Civil Miscellaneous Appeal.

5. Accepting the averments made by the petitioners in the affidavit enclosed with the petition, this Court is inclined to allow this Civil Miscellaneous Petition subject to the condition that the interest for the delay period of 389 days shall stand waived.
