ORDER

This Criminal Original Petition has been filed to quash the proceedings in STC.No.304 of 2022 on the file of the Judicial Magistrate No.II, Ponneri.

2. The learned counsel for the petitioner would submit that while the Criminal Original Petition is pending, the trial has already commenced and the matter is now posted for questioning under Section 313 of Cr.P.C.

3. In view of the above, after the commencement of trial, the prayer for quashing the proceedings cannot be entertained. Hence, the Criminal Original Petition is dismissed. No costs. Consequently, connected miscellaneous petition is closed.

4. However, the Trial Court is directed to complete the trial within a period of three months from the date of receipt of a copy of this order. The personal appearance of the petitioner is dispensed with and he shall be represented by a counsel after filing appropriate application. The petitioner shall be present before the Court below at the time of furnishing of copies, framing charges, questioning under Section 313 Cr.P.C., and at the time of passing judgment.
