This Criminal Miscellaneous Petition has been filed to condone the delay of 111 days in representing this Criminal Appeal against the Judgment dated 21.12.2021 in C.C.No.3362 of 2017 by the learned Metropolitan Magistrate - VIII, George Town, Chennai.

2. When the matter came up for hearing on 04.11.2022, the case is adjourned to 24.11.2022 for filing counter and disposal of the case.

3. Notice was served on the respondent, the respondent also appeared through counsel. The counter is not filed and perused the affidavit filed in support of the petition.

4. The reasons stated in the accompanying affidavit filed in support of the petition is not satisfied. However, in order to give opportunity to the petitioner, since it was an appeal against acquittal, this Court is inclined to condone the delay. In the result, the condone delay petition is ordered. The Registry is directed to number the above Criminal Appeal, if it is otherwise in order. 24.11.2022
