PRAYER: Criminal Original Petition filed under Section 482 of Cr.P.C, praying to direct the respondent to further investigation of the case in Crime No.102/2014 on the file of the respondent and file a final report.

O R D E R

The grievance of the petitioner is that though he has named various persons, who are involved in the offence, the charge sheet has not been laid as against some of these persons. Hence, he seeks for re-investigation.

2. It is seen that the charge sheet was laid way back on 30.06.2014 and at this belated stage, it would not be appropriate to direct the respondent police to re-investigate the matter, after a lapse of almost five years.

3. Nevertheless, Section 319 Cr.P.C vests power to the Court to proceed against other persons appearing to be guilty of offence and in view of the said offence, the petitioner can workout his remedy under Section 319 Cr.P.C.

4. With the above observation, the Criminal Original Petition stands closed.
