This writ petition has been filed challenging the order of suspension passed by first respondent dated 04.01.2024 and for a consequential direction to first respondent to reinstate the petitioner into service with all service and monetary benefits.
2. Heard Mr.C.Prabakaran, learned counsel for petitioner, Mrs.S.Mythreya Chandru, learned Special Government Pleader appearing for respondents 1 and 2 and Mr.R.Kishore Kumar, learned Government Advocate appearing for third respondent.
3. The case of the petitioner is that she was working as a Lab Assistant at Government Higher Secondary School, Chathiramanai, Perambalur District. A First Information Report came to be registered in Crime No.232 of 2023. The petitioner was also arrayed as an accused in this case and the petitioner was arrested and remanded to judicial custody. This resulted in the order of suspension passed by the first respondent through proceedings dated 04.01.2024. This order has been put to challenge in the present writ petition. 2/4
4. In the considered view of this Court, there is no question of interfering with the suspension order. It is seen from records that the petitioner has already made a representation on 17.04.2024 to the first respondent requesting for reviewing and revoking the order of suspension and the same is pending. Therefore, it will suffice if a direction is given to the first respondent to deal with such representation.
5. In the light of the above submission, there shall be a direction to the first respondent to deal with the representation of the petitioner dated 17.04.2024 on its own merits and in accordance with law and pass appropriate orders within a period of six (6) weeks from the date of receipt of a copy of this order.
This writ petition is disposed of with the above direction. No costs. Consequently, connected miscellaneous petition is closed. 19.09.2024 Index: yes/no Speaking Order/Non-Speaking Order gm 3/4
