ORDER

This Criminal Original Petition has been filed by the petitioner to to direct the respondent not to harass the petitioner under the pretext of enquiry.

2. Grievance of the petitioner is that the petitioner has been served with summons by the respondent police pertaining to enqiry in CSR No.783 of 2021 on the complaint given by Mrs.Goli Srilatha.

3. The learned counsel for the petitioner would submit that the said Sri Latha and her husband remitted Rs.43 lakhs during the year 2017 in the petitioner's account, for disbursement of loan and realization for the known persons. Thereafter, the petitioner realized the principal and interest had given to Mrs.Sri Latha and a sum of Rs.9,46,000/- had remitted to Sri https://hcservices.ecourts.gov.in/hcservices/

Latha Bank account during the year 2018. So far the petitioner had repaid the amount of Rs.68 lakhs. This being the case, on the contrary, with false allegation, the said Sri Latha had given a complaint as the petitioner had retaining some cheques and not returned. Further, the learned counsel for the petitioner would submit that on instructions, the petitioner shall appear before the respondent police on 22.12.2021.

4. Learned Additional Public Prosecutor appearing for the respondent would submit that based on the complaint given by Mrs.Sri Latha, summons were issued to the petitioner for the purpose of enquiry, which cannot be termed as harassment.

5. Considering the submissions made by both sides, the petitioner is directed to appear before the respondent police on 22.12.2021 without fail and also give his explanation along with relevant documents. With the abovesaid direction, the Criminal Original Petition is disposed of.
