Respondents Prayer: This Writ Petition is filed under Article 226 of the Constitution of India, seeking for a Writ of Certiorarified Mandamus to call for the records pertaining to the order dated 20.09.2016 passed by the first respondent in Na.Ka.No.56/Thu.KAAKA.CHITHAM/2016, and quash the same and consequently direct the respondents to permit the petitioner to conduct Conference, Rally and Public Meeting on 25.09.2016 or any other subsequent dates at the place of Pole Narayanapillai Street, Chidambaram.

O R D E R

Heard Mr.S.Kumaradevan, representing M/s.V.Porkodi, learned counsel appearing for the petitioner and Mr.A.N.Thambidurai, learned learned Special Government Pleader, accepting notice on behalf of respondents. With the consent of the learned counsel on either side, the Writ Petition itself is taken up for disposal.

In this Writ Petition, the petitioner has challenged the order passed by the first respondent rejecting permission for convening a meeting on 25.09.2016 on the ground that the views that may be expressed by the petitioner and others in the meeting may not be acceptable to other persons and would lead to

a law and order situation.

3. The petitioner is an individual and he states that he is the Secretary of the Virudhai and Chidambaram Wing of the Organization called "Revolutionary Students Youth Front". The petitioner and his team proposed to conduct a meeting and raise their objections in a peaceful manner regarding the recent Educational Policy recommended by the Central Government. It is submitted that for the very same issue, the Students Federation of India had conducted a meeting for which permission has been granted.

After hearing the parties considerably at a length of time, the Investigating Officer, who is present in Court, on instructions from the first respondent, would submit that the petitioner may be permitted to conduct the meeting in the same venue on 25.09.2016 subject to the condition that the meeting should commence from 4.00 p.m., and close by 9.00 p.m., and it will be subject to the usual conditions which may be imposed by the first respondent.

The learned counsel for the petitioner is agreeable to the said proposal and the petitioner would undertake that they will strictly abide by the conditions to be imposed by the first respondent and conduct the meeting in a peaceful manner, without disturbance to the public and there shall be no law and order problem. It is made clear that there may be no procession either by walk or by using cycles or two wheelers and the meeting shall be convened in the concerned area alone.

6. With the above observations, the Writ Petition stands disposed of. No costs. Consequently, connected miscellaneous petition is closed.
