ORDER

The limited prayer sought for in this writ petition is for a direction to the first respondent to dispose of the statutory appeal filed by the Writ Petitioner in Appeal No.RC J5/22049 of 2009.

2. The learned counsel appearing for the Writ Petitioner submitted that in respect of his property, patta was issued in favour of a third party by the Tahsildar, Guindy Taluk, Chennai District in order TR./1383,1384 and 1385/06-07. Challenging the grant of patta in the said order, the writ petitioner preferred an appeal under Section 12 of the Tamil Nadu Patta Pass Book Act, 1983 and Rule 15 of the Tamil Nadu Patta Pass Book Rules, 1987 before the first respondent / District Revenue Officer at Chennai. Though the appeal was filed in the year 2009 itself, no order has been passed till today. The learned counsel for the petitioner submits that the enquiry was already conducted on various dates and no final order has been passed.

3. In view of the submission made by the learned counsel for the petitioner, this Court is inclined to consider the prayer sought for in this Writ Petition. Accordingly, the first respondent is directed to consider the Appeal No.R.C.J5/22049 of 2009, on merits and in accordance with law and pass appropriate orders within a period of eight weeks from the date of receipt of a copy of this order.
