2024-11-11Honourable Mr Justice P. Velmurugan3 pages

P.VELMURUGAN This Writ Petition was already disposed of by this Court on 10.09.2024. Thereafter, it was listed at the instance of the learned counsel for respondents 3 and 5.

2. Today, when the matter is taken up for hearing, the learned counsel appearing for the respondents 3 & 5 submitted that this Court, while disposing of the writ petition on 10.09.2024, had directed the fifth respondent to de-freeze the account and keep a lien over a sum of Rs.2,50,000/- and also permitted the petitioner to operate his Bank account, subject to the condition that he shall ensure that the account shall always have a minimum of Rs.2,50,000/-. Later, the Bank noticed that, apart from the complaints from the Telangana Cyber Crime, few more complaints were filed as against the petitioner. Further, he submitted that mismatch of declared income and flow of funds in the petitioner's account, had prompted the Bank to freeze the Bank account in its entirety and this fact has not been brought to the notice of the Court, at the time of disposal of this writ petition on 10.09.2024 .

3. Heard the learned counsel on either side and perused the materials available on record.

4. It is seen that this writ petition was already disposed on 10.09.2024 of as stated above and now, it is brought to the notice of this Court that, many complaints as against the petitioner, are pending before the Police. Therefore, the details regarding transactions and opening of the Bank account, freezing and de-freezing of Bank account and other related aspects, can be decided only after completion of investigation.

5. In view of the above, the order of this Court dated 10.09.2024 is modified to the extent that the Writ Petition is dismissed. However, the petitioner is at liberty to work out his remedy in the manner known to law and he is also directed to extend his co-operation for investigation. 11.11.2024 mfa Index:Yes/No Speaking Order: Yes/No P.VELMURUGAN, J.
