( Civil Appellate Jurisdiction ) Monday, the Seventh day of February Two Thousand Twenty Two PRESENT THE HON`BLE MRS.JUSTICE J.NISHA BANU CMP.NO.20297 OF 2019 IN CRP(PD)NO.2454 OF 2014 MRS.RAJAPATHI [ PETITIONER ] Vs 1 DEVI [ RESPONDENTS ] 2 BALAJI 3 BASKAR Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to condone the delay of 33 days in filling the restoration of the order of dismissal of the CRP(PD)No.2454/2014.(CMP.NO.20297/2019) Order : This Miscellaneous petition coming on this day for hearing upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S.N.A.RAVINDRAN, Advocate for the petitioner and of MR.S.PANNEER SELVAM, Advocate for the Respondents, the court made the following order:- This petition has been filed to condone the delay of 33 days in filing the petition to restore C.R.P.(PD).No.2454 of 2014.

2. Heard the learned counsel for the petitioner and the learned counsel for the respondents and also perused the materials available on record.

3.On being satisfied with the reasons stated in the affidavit filed in support of the petition and also considering the submissions made by the learned counsel for the petitioner, the delay is condoned subject to the condition that the petitioner shall pay a sum of Rs.1,000/- (Rupees one thousand only) to the Tamil Nadu Legal Services Authority, High Court, Madras within a period of two weeks from the date of this order, failing which, this petition shall stand dismissed automatically without further reference to the Court.
