PRAYER : Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, to direct the learned Judicial Magistrate No. I, Mannargudi, Thiruvarur District to complete the trial in CC.No.376 of 2022 within a time as stipulated by this Court.

O R D E R

This criminal original petition has been filed for a direction to the learned Judicial Magistrate-I, Mannargudi to complete the trial in C.C.No.376 of 2022.

2.The learned Additional Public Prosecutor on instructions submitted that there is case and counter in Crime Nos.81 and 82 of 2022. Insofar as Crime No.81 of 2022 is concerned, it resulted in a final report and it was taken on file in C.C.No.376 of 2022. Insofar as the Crime No.82 of 2022 is concerned, the same also resulted in a final report and it was taken on file in C.C.No.211 of 2023. The learned Additional Public Prosecutor submitted that even though both the cases are pending before the same Court, both has not been clubbed till date.

3.In view of the above, there shall be a direction to the learned Judicial Magistrate-I, Mannargudi to deal with both the cases in C.C.No.376 of 2022 and C.C.No.211 of 2023 in line with the judgment of the Apex Court in 2/4

Nathi Lal and others vs. State of Uttarpradesh and another reported in 1990 (Supp) SCC 145. The proceedings shall be completed by the Court below, within a period of four months from the date of receipt of copy of this order.
