ORDER

This revision petition has been filed seeking to strike off the complaint in DVC.No.4 of 2025 on the file of the Judicial Magistrate, Additional Mahila Court, Thiruppur District.

2. The petitioners herein are the husband, parents in law, sisters in law and grandmother in law of the respondent/wife respectively, who has initiated a domestic violence complaint in DVC.No.4 of 2025, as against the petitioners herein.

3. I have heard the learned counsel for the parties and I have also perused the materials available on record.

4. Though the complaint was lodged as against all the revision petitioners, the learned counsel for the respondent points out that even on 21.01.2025, the learned Judicial Magistrate has found that prima facie case has been made out only against the petitioners 1 to 3 herein and not Page No.2 of 6

against the petitioners 4 to 6. Therefore, there is no necessity to deal with this revision insofar as the petitioners 4 to 6 are concerned.

5. It is also brought to my notice that the respondent has taken separate steps to get the petitioners 4 to 6 impleaded in the domestic violence complaint and the same is pending in Crl.MP.No.1561 of 2025.

6. In view of the above, this Court directs the Judicial Magistrate, Additional Mahila Court, Thiruppur District to decide the said application in Crl.MP.No.1561 of 2025 on its own merits and in accordance with law within a period of four weeks from the date of receipt of a copy of this order.

7. Insofar as the petitioners 1 to 3, being the husband and parents in law of the respondent are concerned, on going through the domestic violence complaint, I find that several allegations have been made against these petitioners and it is a matter for trial. Page No.3 of 6

8. Though it is contented by the learned counsel for the petitioners that the respondent/wife resided with the petitioners' family only for six months and the allegations are false, it cannot be decided summarily by this Court in the present revision under Article 227 of the Constitution of India.

9. In the light of the above, while dismissing the present revision, this Court directs the learned Judicial Magistrate, Additional Mahila Court, Thiruppur District not to insist upon the physical presence of the petitioners, be it the petitioners 1 to 3 or 4 to 6, in the event of them being impleaded, subject to the orders being passed in Crl.MP.No.1561 of 2025.

10. Further, the learned Judicial Magistrate, Additional Mahila Court, Thiruppur District shall expedite the trial/enquiry in DVC.No.4 of 2025 and shall dispose of the same finally on merits and in accordance with law on or before 31.10.2025, after hearing the parties. Page No.4 of 6

11. For the reasons aforesaid, this Civil Revision Petition stands dismissed. No costs. Consequently, the connected Miscellaneous petitions are closed.
