This is the third bail petition filed by the petitioner, who was arrested and remanded to judicial custody on 27.02.2022 for the offences punishable under Sections 366, 506(ii) of IPC r/w Section 6 of POCSO Act, 2012 in Spl.S.C.No.103 of 2022 in Crime No. 8 of 2022 on the file of the respondent police.

2. The case of the prosecution is that de-facto complainant, the father of the victim child, gave the complaint as his minor daughter aged 6 years was subjected to sexual assault by the petitioner/accused. Hence, the complaint.

3. Earlier, this Court had dismissed the bail petitions filed by the petitioner in Crl.O.P.No.11645 of 2022 and Crl.O.P.No.19106 of 2022 on 06.06.2022 and 12.08.2022 respectively, considering the fact that the petitioner had committed very serious and heinous offence as against the minor victim girl aged about 6 years.

4. Taking into consideration of the facts and circumstances of the case, and that there is no change in circumstances of this case, this Court is not inclined to grant bail to the petitioner.
