PRAYER: Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, to direct the third respondent to provide police protection to the petitioner in doing the construction work for Indian Oil Petrol bunk at Nadu Hale Village Survey no.100/3ADharmapuri District and thus render justice.

ORDER

This petition has been filed to direct the 3rd respondent to provide police protection to the petitioner in doing the construction work for Indian Oil Petrol bunk at Nadu Hale Village Survey no.100/3A Dharmapuri District.

2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing on behalf of the respondents.

3.The grievance of the petitioner is that on the complainant of the petitioner, the respondent police assigned C.S.R.No.682 of 2021 and thereafter no action has been taken. It is the https://hcservices.ecourts.gov.in/hcservices/

further grievance of the petitioner is that the petitioner had taken the land of one Gopal, on lease for carrying on petrol bunk business and entered into a lease agreement dated 13.03.2020. Thereafter, he had also applied for a licence for putting up petrol bunk. The Indian Oil Corporation on verification of the documents granted licence to the petitioner. When the petrol bunk work commenced, at the ill advise of one Thambidurai who is the relative of said, the said Gopal and Thambidurai along with their henchmen were threatening the petitioner and they did not permit the petitioner to carry on petrol bunk business. Hence, he has sought for police protection.

4.Learned Additional Public Prosecutor would submit that on the complaint and counter complaint of Gopal as well as Thambidurai, they were called for enquiry on 23.09.2021 and it was agreed by both the parties that they have no objection in leasing out the said property to the petitioner, as the said Thambidurai had signed the lease agreement as a witness, based on which a licence was granted to the petitioner. Explaining the said facts to the counter parties viz. Gopal and Thambidurai, both of them have agreed that they will not disturb the peaceful possession and business of the petitioner continuing with the Petrol Bunk business.

5.Recording the same, the complaint in the C.S.R.No.682 of 2021 stands closed.
