C.M.P.No.21626 of 2023 in A.S.No.553 of 2021 P.T.ASHA, J., The above application is filed for receiving the Sale Deed dated 04.01.2008 executed by the first defendant in favour of the second defendant. The defendants have admitted the Sale Deed and in fact in paragraph 5 of the written statement of the second defendant, the second defendant has stated as follows:- "This defendant submits that at the time of purchase of the property by this defendant, no sale agreement was in force under law and no suit is pending in respect of the property purchased by this defendant as per the registered sale deed dated 04.01.2008.

Therefore, this defendant is bonafide purchaser for value and binding consideration."

However, the defendants have not marked the sale deed.

2.Considering the fact that this is an admitted document, no prejudice would be cause to the appellant if the same is received. Accordingly, this application is ordered.
